Governor Cuomo Closes Out-of-State Gun Loophole

As part of the FY 2021 Enacted Budget, Governor Cuomo has added legislation that contains a significant change to the existing gun laws in already-restrictive NYS. The sweeping change now prohibits individuals who commit serious out-of-state offenses from obtaining gun licenses in New York State. Therefore, if you are someone who committed such an offense out of NYS, you are no longer capable of purchasing a gun in New York.

Furthermore, you should note that the Enacted Budget will also include legislation that requires all state and local law enforcement agencies in New York State to participate in the ATF’s crime gun trace data-sharing program. This means that they must now submit criminal guns recovered through the ATF’s eTrace system. Finally, the newly Enacted Budget will amend the Mental Hygiene Law, allowing New York State to share reports with other states of persons the state believes are a danger to themselves or others.
