Marijuana Legalized in NYS | What You Should Know

Not so long ago in New York State, marijuana was decriminalized. Now, it has been announced that the recreational use and possession of marijuana has been legalized in NYS. As per the new law, marijuana may be legally produced and sold to all adults who are 21 years and older. Additionally, on top of legalizing the recreational use of marijuana, the law will also expunge various marijuana-related convictions from people’s records. This is a momentous step in progressive marijuana law, and many New York residents are pleased that the drug has finally been legalized for recreational purposes.

In a statement regarding the move to legalize recreational marijuana in NYS, New York Governor Andrew Cuomo said, “For generations, too many New Yorkers have been unfairly penalized for the use and sale of adult-use cannabis, arbitrarily arrested and jailed with harsh mandatory minimum sentences. After years of tireless advocacy and extraordinarily hard work, that time is coming to an end in New York State. Legalizing adult-use cannabis isn’t just about creating a new market that will provide jobs and benefit the economy — it’s also about justice for long-marginalized communities and ensuring those who’ve been unfairly penalized in the past will now get a chance to benefit. I look forward to signing this legislation into law.”

How much marijuana can I possess under the new law in NYS?

Under the new law, it is important that you understand that there are limits to the amount of marijuana you may possess. For example, you are only allowed to possess three ounces of cannabis and up to 24 grams of cannabis concentrate outside of your home. You should also note that after 18 months have elapsed, you cannot grow or cultivate more than three mature plants and three immature plants, and there may be no more than six immature per household–provided you are over the age of 21.

Will my record be expunged under the new marijuana law?

In many cases, if you’ve been previously convicted of a marijuana-related charge, there is a very good chance that you may have your record expunged.
