Consequences of Disobeying a Traffic Control Device

Disobeying a traffic control device is a two-point ticket in the State of New York and carries a fine of up to $150 plus a surcharge. Very often disobeying a traffic control device ticket is given in lieu of what we call a roadside reduction, such as speeding, based upon another traffic infraction. For example, someone who may have originally been speeding, if the police officer wants to do them a favor rather than giving them a speeding ticket they may give them a ticket for disobeying a traffic control device. Similarly someone who perhaps ran a red light or a stop sign may get a ticket for disobeying a traffic control device. Instead of receiving a three point running a red light ticket, the police officer will give them a two point disobeying a traffic control device.

Often if someone is charged with speeding, a skilled attorney might be able to work out a reduction to disobeying a traffic control device in lieu of pleading guilty to speeding. If you receive a ticket for disobeying a traffic control device, it does carry two points in New York. One needs to be leery of pleading guilty because of the potential impact it can have on both your driving privileges and on your insurance rates. Before pleading guilty to such a ticket, one should immediately contact a lawyer who is experienced in traffic control device tickets.
