What is Leandra’s Law?

Leandra’s Law is a new law that was recently passed by New York State that elevates a first time misdemeanor DWI offense to a felony if you were drunk driving with a minor in the car. Specifically, a person under the age of 14.

Automatically, this is a separate felony DWI charge and elevates a misdemeanor charge to a felony charge. That subjects you to a grand jury presentment if the prosecutor so chooses. If the grand jury indicts you, the case now begins brand new in county court. You can face a state prison sentence, a five-year term of probation, as well as loss of license for at least a year from the court and possibly more from the DMV.
