What are the Fireworks Regulations in New York State this Fourth of July?

Fourth of July celebrations are known for their huge firework displays. Fireworks Regulations in New York State

New York State modified fireworks laws for the first time since 1914 a century later in 2014. Since the adjustment, the use and sale of sparking devices have been allowed in New York. The law also states Ground-based or handheld sparkling devices including cylindrical fountains, cone fountains, and wood sparklers/dipped sticks; party poppers, snappers are allowed. What is not allowed include aerial consumer fireworks, firecrackers, chasers, skyrockets, roman candles, bombs, and metal wire sparklers.

The sale and use of Sparkling Devices are legal in counties and cities that have not enacted a local law pursuant to section 405.00 of the Penal Law of NY.

The following counties have prohibited the use and sale of Sparkling Devices according to The Office of Fire Prevention and Control:

  • Albany
  • Bronx
  • Columbia
  • Kings
  • Nassau
  • New York
  • Orange (in the Cities of Middletown and Newburgh)
  • Queens
  • Richmond
  • Schenectady
  • Suffolk
  • Westchester

It is also important to note that anyone under the age of 18 is permitted to use sparkling decides. This is regardless of whether they have been legalized.

Sparkling Devices sellers, manufacturers, distributors, and wholesalers who are conducting business in New York State are required to apply for a certification with the Office of Fire Prevention and Control. They are also required to pay a yearly fee.
