What happens if I am caught shoplifting in New York State?

Of course, shoplifting is illegal, and if you are caught in the act, you will face several potential consequences. That being said, the consequences you face are largely dependent upon the dollar amount of goods that were stolen. The penalties for shoplifting in New York State are as follows:

  • Stolen property valued at less than $1,000: This is also sometimes referred to as petit larceny. If charged, you may face a class A misdemeanor, which means you may owe $1,000 in fines, and you may spend up to one year in jail.
  • Stolen property valued between $1,000 and $3,000: Stealing property valued between $3,000-$5,000 is referred to as grand larceny in the fourth degree. If convicted, you will face a class E felony, which results in either up to $5,000 in fines, or double your monetary gain from the theft, whichever is more, as well as potential imprisonment of up to 4 years.
  • Stolen property valued between $3,000 and $50,000: This is grand larceny in the third degree. If convicted, you will face very high fines and up to 7 years of incarceration.
  • Stolen property valued between $50,000 and $1 million: This is grand larceny in the second degree, which is a class C felony. For a class C felony, you may face hefty fines, as well as up to 15 years of incarceration.
  • Stolen property valued over $1 million: This is grand larceny in the first degree, a class B felony, and if you are convicted, you may spend up to 25 years in prison.
